2) Scope of application

2.1 ) The purpose of these general conditions is to regulate the access, navigation and use of the contents offered by QLM and accessible through the QLM Internet portal (through the domain name qlm.es, as well as any other QLM domains that may be used in the future) (hereinafter, the “Portal“). However, QLM reserves the right to establish particular conditions that regulate the use and/or contracting of specific services offered to the Users through the Portal. In this sense, User shall be understood as the person who accesses, navigates or uses the free or onerous services accessible through the Portal.

2.2 ) It is understood that the access or the mere use of the Portal by the User implies the User’s adherence to the general conditions that are published on the Portal. Consequently, the User is recommended to read carefully the general conditions applicable at all times.

2.3) QLM reserves the right to modify these terms and conditions, totally or partially.

3) Intellectual and industrial property rights

3.1) All the contents of the Portal, including, without limitation, texts, images, designs, programs, applications, trademarks and logos, are property of QLM or, if applicable, of third parties with whom the corresponding license agreements have been signed and are protected by intellectual and industrial property rights.

3.2) The contents of the Portal are issued for information purposes only and may be modified and updated at any time.

3.3) The names “QUANTUM LEAP MANAGEMENT” and “QLM” are the exclusive property of QLM. In relation to the names, trademarks or trade names, registered or not, as well as any content of the Portal, their reproduction and, in general, any form of exploitation thereof without the prior consent of QLM is expressly prohibited.

4) Links to other websites

In the Portal, the User may find links to other websites through different links, banners, etc., whose management corresponds to third parties. Likewise, QLM does not assume any type of responsibility derived from any aspect related to third party websites to which a link is established from the Portal.

5) Data protection

All information sent to QLM through the forms or data collection devices accessible on the Portal, will be treated confidentially and, to the extent that it involves the processing of personal data, this treatment will be carried out in accordance with the provisions of current legislation on data protection, especially in the provisions contained in the General Data Protection Regulation (Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC). QLM will process personal data for the purpose of managing the relationship with the Users, and, where appropriate, to carry out a correct management of the services provided by QLM.

6) Cookies

What are cookies?

Cookies are procedures that are generated automatically when browsing websites. By means of these procedures, small data files are generated in the User’s computer equipment, imperceptible to the User, by means of which QLM can have access to certain personal information of the User, among others, information related to: date and time of the last visit of the User to the Portal; information of the Portal that was consulted by the User in his last visit; origin of the User. Thus, each time the User accesses the Portal again, the files mentioned in the previous paragraph will be automatically activated, thus configuring the website with the preferences indicated in the User’s previous visits. This type of files called “session cookies” may be used by QLM during the User’s access to the Contents.

All Users have an option to prevent the generation of cookie files or to warn the User when such files are going to be created. For it, the User has to select the option that corresponds according to its program of Navigator.

7) Limitation of liability

Access by Users to the Portal does not imply any obligation on the part of QLM to control the absence of viruses or computer elements that may have a harmful effect on the User’s computer equipment. In any case, it shall be the User’s responsibility to have the necessary tools to detect such viruses or harmful computer elements. For all of the above, QLM shall not be liable for any possible damage caused to the Users’ or third parties’ computer equipment while browsing through the Portal or accessing its Contents.

8) Jurisdiction

These General Conditions shall be governed and interpreted by the Spanish law in force.

For the interpretation or execution of the provisions contained in these General Conditions, QLM and the User agree to submit to the Courts and Tribunals of the city of Madrid, expressly waiving any other jurisdiction that may correspond to them.
